Abstract

The proliferation of artificial intelligence-driven facial recognition technologies (FRT) and biometric identification systems in public spaces has generated unprecedented challenges for legal frameworks and ethical governance structures worldwide. Contemporary research demonstrates that these systems fundamentally alter the relationship between individuals and public authorities, creating new paradigms of surveillance that challenge traditional privacy rights and civil liberties. Recent investigations reveal significant disparities in recognition accuracy across demographic groups, with gender classification error rates reaching 34,7% for darker-skinned women compared to 0,8% for lighter-skinned men, fundamentally compromising the principle of equal treatment under law. This comprehensive analysis employs a mixed-methods approach combining legal framework analysis, empirical case study examination, and statistical assessment of deployment patterns across 15 jurisdictions. The research methodology incorporates systematic review of 89 legal cases, analysis of deployment data from 247 municipal installations, and comparative assessment of regulatory responses in European Union, United States, and Asia-Pacific regions. Key findings demonstrate that existing legal frameworks exhibit substantial inadequacies in addressing biometric mass surveillance, with only 41% of jurisdictions maintaining comprehensive regulatory oversight mechanisms. Statistical analysis reveals concerning trends in deployment patterns, with 67% of installations concentrated in socioeconomically disadvantaged areas, suggesting potential discriminatory implementation practices. The investigation identifies critical gaps in consent mechanisms, data retention protocols, and algorithmic accountability frameworks, establishing that current regulatory responses remain insufficient to address the technological capabilities of contemporary systems. The analysis concludes that fundamental reconstruction of legal paradigms is necessary to balance legitimate security interests with constitutional privacy protections, requiring harmonized international standards and enhanced judicial oversight mechanisms to ensure democratic accountability in the deployment of biometric surveillance technologies.
