			<abstract xml:lang="ru"><p>Распространение технологий распознавания лиц на основе искусственного интеллекта (FRT) и систем биометрической идентификации в общественных местах породило беспрецедентные проблемы для законодательной базы и структур этического управления во всем мире. Современные исследования показывают, что эти системы коренным образом меняют взаимоотношения между отдельными лицами и органами государственной власти, создавая новые парадигмы слежки, которые бросают вызов традиционным правам на неприкосновенность частной жизни и гражданским свободам. Недавние исследования выявили значительные различия в точности распознавания между демографическими группами, при этом частота ошибок в классификации по признаку пола достигает 34,7% для темнокожих женщин по сравнению с 0,8% для светлокожих мужчин, что в корне противоречит принципу равного обращения по закону. В этом всестороннем анализе используется подход со смешанными методами, сочетающий анализ правовой базы, изучение эмпирических примеров и статистическую оценку моделей развертывания в 15 юрисдикциях. Методология исследования включает систематический обзор 89 судебных дел, анализ данных о размещении на 247 муниципальных объектах и сравнительную оценку мер регулирования в Европейском союзе, Соединенных Штатах и Азиатско-Тихоокеанском регионе. Основные выводы свидетельствуют о том, что существующие правовые рамки демонстрируют существенные недостатки в решении проблемы массового наблюдения за биометрическими данными, поскольку только в 41% юрисдикций существуют всеобъемлющие механизмы нормативного надзора. Статистический анализ показывает, что 67% установок сосредоточены в социально-экономически неблагополучных районах, что свидетельствует о потенциальной дискриминационной практике внедрения. Расследование выявило критические пробелы в механизмах получения согласия, протоколах хранения данных и алгоритмических системах подотчетности, установив, что текущие меры регулирования остаются недостаточными для удовлетворения технологических возможностей современных систем. В результате анализа делается вывод о том, что необходима фундаментальная перестройка правовых парадигм, чтобы сбалансировать законные интересы безопасности с конституционной защитой частной жизни, что требует согласования международных стандартов и усиления механизмов судебного надзора для обеспечения демократической подотчетности при внедрении технологий биометрического наблюдения.</p></abstract><trans-abstract xml:lang="en"><p>The proliferation of artificial intelligence-driven facial recognition technologies (FRT) and biometric identification systems in public spaces has generated unprecedented challenges for legal frameworks and ethical governance structures worldwide. Contemporary research demonstrates that these systems fundamentally alter the relationship between individuals and public authorities, creating new paradigms of surveillance that challenge traditional privacy rights and civil liberties. Recent investigations reveal significant disparities in recognition accuracy across demographic groups, with gender classification error rates reaching 34,7% for darker-skinned women compared to 0,8% for lighter-skinned men, fundamentally compromising the principle of equal treatment under law. This comprehensive analysis employs a mixed-methods approach combining legal framework analysis, empirical case study examination, and statistical assessment of deployment patterns across 15 jurisdictions. The research methodology incorporates systematic review of 89 legal cases, analysis of deployment data from 247 municipal installations, and comparative assessment of regulatory responses in European Union, United States, and Asia-Pacific regions. Key findings demonstrate that existing legal frameworks exhibit substantial inadequacies in addressing biometric mass surveillance, with only 41% of jurisdictions maintaining comprehensive regulatory oversight mechanisms. Statistical analysis reveals concerning trends in deployment patterns, with 67% of installations concentrated in socioeconomically disadvantaged areas, suggesting potential discriminatory implementation practices. The investigation identifies critical gaps in consent mechanisms, data retention protocols, and algorithmic accountability frameworks, establishing that current regulatory responses remain insufficient to address the technological capabilities of contemporary systems.
